1. Operator and parties to the agreement
The PartyM8 mobile app and service are operated by:
UNIVEUM OÜRegistry code: 17610783
Ahtri tn 12, Kesklinna linnaosa
15551 Tallinn, Harju maakond
Estonia
partym8@univeum.eu
The agreement for the use of PartyM8 is entered into between the Operator and the person who creates an account, uses the app or purchases a paid feature. “User” means both an ordinary participant and an organiser publishing events, unless a particular provision indicates otherwise.
2. Acceptance of the Terms
By creating an account, ticking the relevant box, purchasing a paid feature or continuing to use PartyM8 after the Terms have been made available, you accept these Terms.
If a user does not accept the Terms, they should not create an account or use the service. Certain features may be subject to additional rules presented before they are used; in the event of any conflict, the specific rules for the feature concerned will prevail.
3. Age and eligibility
PartyM8 may only be used by people who are at least 18 years old and have the capacity to enter into a binding contract under the applicable law.
By creating an account, the user confirms that they meet this requirement. The Operator may ask for additional confirmation of age or identity where this is justified by safety, legal requirements, payment processing or organiser verification.
A person using PartyM8 on behalf of a company, club or other organisation confirms that they are authorised to bind that entity to these Terms.
4. User account
- The user must provide information that is true, up to date and does not infringe the rights of others.
- A single person should not create multiple accounts in order to get around blocks, manipulate results or mislead others.
- The user is responsible for keeping their login details secure and for activity carried out through their account, unless it results from circumstances for which they are not responsible.
- Accounts must not be sold, rented, transferred or shared with third parties.
- Any suspected account takeover must be reported to the Operator without delay.
The user may delete their account using the feature available in the app or by submitting an appropriate request. Deleting an account does not automatically delete data that must be retained for legal, accounting or security reasons or for the purpose of resolving a dispute.
5. Scope of the service
PartyM8 may enable users, among other things, to:
- discover events, clubs, dances and parties by date, location, distance or category;
- use the map, calendar and recommendations;
- create a profile, search for other people and indicate attendance at an event;
- send messages and invitations and interact with other users;
- publish photos, videos, comments, stories and other content;
- create, promote and manage events (for organisers);
- use paid features, advertising or promotions.
The scope and availability of features may vary depending on the country, app version, device, settings, account type and any tests being run.
6. Safety rules
Do not share sensitive information straight away. Do not give strangers your home address, documents, bank details, codes, passwords or any information that would allow them to take over your account.
Meet in safe places. Tell someone you trust about your plans, arrange your own independent transport and never leave your drink unattended.
Do not drive under the influence of alcohol or other intoxicating substances. PartyM8 does not encourage dangerous, illegal or excessive drinking.
In the event of immediate danger, contact your local emergency services. PartyM8 is not an emergency service and does not guarantee an immediate response to any report.
7. User content
The user retains the rights to the content they publish on PartyM8. By uploading content, the user grants the Operator a non-exclusive, worldwide, royalty-free licence to store, copy, technically process, compress, display, distribute and make that content available to the extent necessary to operate, promote, secure and improve PartyM8.
The licence lasts for as long as the content is made available and for a reasonable technical period after its deletion, including in backups. Material shared with other users may remain in their messages, on their devices or in copies over which the Operator has no control.
The user represents that they hold the rights and consents necessary to publish the content, including in relation to a person's image and to music, photographic and video material, and that publishing it does not breach the law or the rights of third parties.
8. Prohibited content and conduct
PartyM8 must not be used to publish, send, promote or facilitate content or conduct that:
- is unlawful, fraudulent or misleading, or infringes the rights of third parties;
- involves threats, harassment, stalking, violence, blackmail, hate speech or degrading treatment;
- promotes terrorism, crime, human trafficking, drugs, weapons or other illegal goods and services;
- involves sexual exploitation, non-consensual sexual content, intimate images shared without consent, the sexualisation of minors or any content depicting child abuse;
- impersonates another person or falsifies an event, tickets, identity, affiliation or organiser status;
- solicits money, financial details, codes or login details under false pretences;
- violates privacy or discloses another person's data, location or correspondence without a proper basis;
- contains spam, mass advertising, automated messages or malware, or attempts to disrupt the service;
- infringes copyright, trade marks, image rights or other intellectual property rights;
- circumvents security measures, blocks, limits, payment mechanisms or moderation decisions;
- promotes events without the required permits, in places that are not lawfully accessible or on terms that endanger attendees.
The prohibition also covers attempting, assisting or encouraging such conduct and using other accounts to carry it out.
9. Moderation, reports and appeals
PartyM8 may use automated tools and human review to detect spam, fraud, illegal content, safety threats and breaches of the Terms.
Users may report content, accounts and behaviour using the features available in the app. In particular, the Operator may restrict visibility, remove content, suspend the publication of an event, restrict communication, suspend an account, cancel a promotion or delete an account.
When making decisions, we may take into account the nature of the breach, the context, the account history, the risk to users, legal obligations and the credibility of the report. Where an appeal feature is available, the user should use it within the time limit stated in the notification.
The Operator may retain material relating to a suspected criminal offence or a serious threat and pass it to the relevant authorities. Applicable law may require certain content to be reported to the competent bodies.
10. Events and organisers' obligations
An organiser publishing an event is responsible for its lawfulness, the accuracy of the information provided, and holding the necessary rights, consents, licences, permits, insurance and authorisations to use the venue and promotional materials.
In particular, the organiser undertakes to:
- provide up-to-date information on the date, venue, price, age restrictions, admission rules and accessibility;
- state clearly who the organiser is and who is selling the tickets;
- comply with the rules on safety, consumer protection, advertising, alcohol, music, data protection and accessibility;
- update information promptly if the event is changed or cancelled;
- deal with attendees, complaints and refunds where the organiser is a party to the contract relating to the event or ticket.
Unless PartyM8 expressly states otherwise, the Operator is not the organiser, the seller of the ticket or a party to the contract between the attendee and the organiser. Publishing or promoting an event does not constitute an endorsement of it or a guarantee of its quality, safety, attendance or conformity with its description.
The Operator may ask the organiser for documents or information confirming the credibility of the event and may refuse to publish or promote it if there are reasonable doubts.
11. Contacts and offline meetings
Users decide for themselves whether, and on what terms, to meet outside the app. PartyM8 does not supervise such meetings and, as a rule, does not carry out full background checks on users.
Users should exercise reasonable caution, verify basic information, meet in a public place, tell someone they trust, control their own transport and end the contact if they feel uncomfortable or unsafe.
12. Location and accuracy of information
Information about distance, location, venue availability, event times and recommendations may be approximate, delayed or dependent on information provided by users and third parties. Key details should be confirmed directly with the organiser before setting off.
Using PartyM8 to track people, establish their exact whereabouts without consent or take any action that compromises their privacy and safety is prohibited.
13. Paid features, promotions and subscriptions
PartyM8 may offer one-off purchases, paid event promotion, premium features or subscriptions. The price, currency, taxes, scope of the service, billing period and renewal terms are presented before purchase.
Payment may be processed by the Apple App Store, Google Play or another payment provider. In that case, the user is also subject to that provider's terms, and the subscription and payment method may be managed through the provider's system.
If a purchase is an auto-renewing subscription, it will renew in accordance with the information displayed before purchase until it is cancelled. Deleting the app or the account does not always cancel the subscription; it must be cancelled in the settings of the relevant store or payment provider.
A paid promotion increases exposure as described in the product description, but does not guarantee any specific number of views, attendees, ticket sales or business results, unless a measurable deliverable was expressly specified before purchase.
14. Cancellation, withdrawal and refunds
The user may cancel future subscription renewals in accordance with the payment provider's instructions. Access to a paid feature may remain active until the end of the current period, unless the applicable law or the provider's terms state otherwise.
For purchases made through an app store, refund requests may be subject to that store's procedure. This does not limit the rights the consumer has by law.
Where the law grants a 14-day right of withdrawal from a distance contract, the user may lose that right in respect of digital content once they have consented to the supply starting immediately and acknowledged that they will lose the right of withdrawal. In the case of a service started at the user's express request, the user may be required to pay for the part performed up to the time of withdrawal, in accordance with the applicable law.
A promotion that has already been delivered or has started in accordance with the order may not be eligible for a full refund, subject to the consumer's mandatory statutory rights and to cases where the service was faulty or not as described.
15. PartyM8 intellectual property
The app, code, interface, graphics, the PartyM8 name, logo, databases, content layout and the Operator's materials are protected by law. These Terms grant the user a limited, personal, non-exclusive, revocable and non-transferable right to use the service for its intended purpose.
Without written permission, users must not copy, sell or sublicense the service, reverse engineer the code, circumvent security measures, scrape data in bulk, create a competing database or use the PartyM8 name or marks in a way that suggests a partnership.
Feedback and suggestions about the development of the app may be used by the Operator without any obligation to pay, unless the parties agree otherwise.
16. Third-party services and content
PartyM8 may work with maps, ticketing systems, payment providers, app stores, organisers' websites and other services. The Operator does not control their operation, prices, availability or content and is not responsible for independent contracts entered into by the user with those parties.
A link or integration does not imply an endorsement. The user should read the rules, privacy policy and purchase terms of the relevant provider.
17. Suspension and deletion of accounts
The Operator may take proportionate protective measures, including a warning, restricting features, hiding content, suspending a promotion, temporarily suspending or deleting an account, where:
- the user breaches the Terms or the law;
- the account poses a risk to other people, the service or the infrastructure;
- fraud, account takeover or circumvention of security measures is suspected;
- this is required by a public authority, court, payment provider or app store;
- this is necessary to investigate a report or prevent harm.
Where possible, we will inform the user of the reason and of the available appeal procedure, unless doing so is prohibited by law, could hinder proceedings or would increase the risk.
The user may terminate the agreement by deleting their account. Provisions concerning rights to content, payments, liability, disputes and data will continue to apply to the extent that their nature requires.
18. Availability and changes to the service
We aim to keep PartyM8 safe and useful, but we do not guarantee that it will operate without interruption or errors. The service may be temporarily unavailable due to maintenance, updates, failures, the actions of providers, threats or events beyond the Operator's reasonable control.
We may develop, add, change or withdraw features. If a change materially affects a paid feature, we will apply the remedy required by law and by the terms of purchase.
19. Liability
PartyM8 is a technology platform. Unless expressly stated otherwise, the Operator is not a party to relationships between users or to any contract relating to an event, ticket, transport, payment to an organiser or a service provided by a third party.
The Operator does not guarantee the identity, intentions or conduct of users and organisers or the accuracy of all the information they provide. Users are responsible for their own decisions, contacts, content, event organisation and compliance with the law.
To the extent permitted by law, the Operator is not liable for indirect losses, loss of profit, loss of opportunity, reputation or data that could not reasonably have been foreseen when the agreement was entered into, or for the actions of independent users, organisers and providers.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded, in particular liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any mandatory consumer rights.
20. Consumer rights
If the user is a consumer, they have the rights provided by the applicable legislation, including rights relating to satisfactory quality and to services or digital content conforming to their description. These Terms do not limit those rights.
If there is a problem with a paid feature, the user should contact the Operator or the relevant payment provider, describing the order and the problem. Handling the matter may require the transaction ID and technical information.
21. Changes to the Terms
The Terms may be amended in connection with changes in the law, security, the service model, features, providers or payment methods. The current version will be available in the app or on the website, together with its effective date.
We will give reasonable advance notice of material changes, unless an immediate change is necessary for legal or security reasons. Continued use after the changes take effect constitutes acceptance of the new version; a user who does not accept it may stop using the service.
22. Governing law and disputes
These Terms and the agreement with the Operator are governed by the law of the Republic of Estonia. If the user is a consumer living in another country, they retain the protection afforded to them by the mandatory provisions of the law of the country of their habitual residence.
Before taking a matter to court, we encourage users to submit a complaint and try to resolve the dispute amicably. A consumer may bring claims before the competent court in accordance with the rules that apply to them. These Terms do not impose mandatory arbitration or deprive anyone of the right to use the competent court or authority.
23. Privacy
The rules on the processing of personal data are set out in the separate PartyM8 Privacy Policy. When using the app, users should read that document and manage their profile, location, visibility and notification settings.
24. Contact and complaints
Questions, complaints and reports concerning the Terms can be sent via the contact channel available in the app or on the partym8.com website, or by post to:
